These Terms & Conditions ("Terms") govern your access to and use of getbrewtal.com and all products and services offered by Pacy Labs Private Limited ("we", "us", "Brewtal"). By visiting this website, registering your interest, placing a pre-booking, or purchasing any product, you agree to these Terms in full. If you do not agree, please do not use this website or place an order.

Pacy Labs Private Limited is a Private Limited Company incorporated under the Companies Act, 2013, operating under the brand name Brewtal.

We operate two business lines:

• B2C (Consumer):  BrewtalGo (home chai maker) and Chai Bombs (consumable chai pods), sold via getbrewtal.com

• B2B (Enterprise): Chai Bot, an automated chai and coffee dispensing machine installed in offices on a subscription basis, governed by a separately executed Service Agreement

2. Eligibility

You must be at least 18 years of age to transact on this website. By using it, you confirm you meet this requirement. If you are transacting on behalf of a company or organisation, you confirm that you have the authority to bind that entity to these Terms.

3. Products & Current Stage

Brewtal is at a pre-commercial stage for its B2C products. Current status:

• Chai Bombs: In active beta testing and to be launched soon for commercial sales. Samples are distributed free of charge to selected individuals solely for feedback purposes. 

• BrewtalGo: In trial stage. The machine is loaned to selected testers for a defined period and returned to Brewtal thereafter. Testers do not purchase or own the machine during this period.

• Pre-Bookings: We are accepting pre-booking deposits of ₹499 for BrewtalGo. This secures your place in the launch queue and is fully refundable. It does not constitute a completed sale.

Trial participation is voluntary and at Brewtal's discretion. Brewtal may modify or discontinue trials at any time without obligation.

4. Proper Use & Misuse

"Proper Use" means operating the BrewtalGo machine:

• Indoors, in a residential setting, on a stable, heat-safe, flat surface with adequate ventilation

• Strictly in accordance with the User Guide, including maximum fill levels, water type specifications (RO water only — not tap water or hard water), and cleaning instructions

• With Brewtal-approved Chai Bombs and consumables only

• With firmware and software kept up to date, where applicable

• For personal, household use only — not for commercial, industrial, or high-volume catering use

"Misuse" means any use outside Proper Use, including but not limited to:

• Using tap water, hard water, or non-approved liquids (hard water causes heater scale build-up and damage — not covered under warranty)

• Using non-Brewtal consumables or third-party pods in the machine

• Operating the machine unattended contrary to the User Guide

• Allowing unauthorised persons to tamper with, repair, or modify the machine

• Blocking vents, placing the machine near combustible materials, or exposing it to outdoor conditions

• Overfilling beyond specified limits

• Using the machine in a commercial or industrial environment

Damage arising from Misuse is not covered under warranty and may void your rights under our returns and service policy.

5. Intellectual Property

All content on getbrewtal.com including the Brewtal name, logo, brand identity, product names (BrewtalGo, Chai Bombs, Chai Bot), machine design, IoT software, Android UI, recipes, photography, and all written content is the exclusive property of Pacy Labs Private Limited and protected under applicable Indian and international intellectual property laws. No reproduction, distribution, modification, or commercial use of any content is permitted without prior written consent from Brewtal.

6. Acceptable Use

You agree not to:

• Use this website for any unlawful or fraudulent purpose

• Submit false, misleading, or incomplete information when registering interest or placing a pre-booking

• Attempt to reverse-engineer, hack, scrape, or disrupt any part of our website or connected systems

• Infringe upon the intellectual property rights of Brewtal or any third party

• Resell, rent, or commercially exploit any products purchased from Brewtal without prior written authorisation

• Use this website to build a competing product or service

7. Indemnification

You agree to defend, indemnify, and hold harmless Pacy Labs Private Limited and its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your Misuse of BrewtalGo or any Brewtal product

• Your breach of these Terms or the User Guide

• Any content you submit to us

• Your violation of any applicable law

This indemnification does not apply to claims arising from Brewtal's own gross negligence or wilful misconduct.

8. Disclaimer of Warranties

Our website and products are provided on an 'as is' and 'as available' basis. Brewtal makes no warranties express or implied regarding uninterrupted availability, fitness for a particular purpose, or merchantability. Product specifications, features, and pricing shown on the website are indicative and subject to change prior to commercial launch.

9. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Pacy Labs Private Limited shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website or products, including loss of profits, data, or business opportunity.

For direct physical damage to property caused by a manufacturing defect in BrewtalGo while operated under Proper Use, Brewtal's total liability shall not exceed the amount paid by you for the machine.

Brewtal is not liable for food or ingredient loss or spoilage arising from machine use or malfunction.

Our maximum aggregate liability in any matter shall not exceed the amount you paid for the specific product or service giving rise to the claim in the 12 months before the claim arose.

You are advised to maintain appropriate home appliance insurance for any high-value kitchen appliance, including BrewtalGo.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Before raising a formal dispute, both parties agree to attempt resolution through direct discussion for a period of 30 days. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a mutually appointed sole arbitrator. Arbitration proceedings shall be held in Bengaluru, Karnataka, conducted in the English language. The courts of Bengaluru shall have exclusive jurisdiction over matters ancillary to the arbitration.

11.  Amendments

Brewtal may update these Terms at any time. Material changes will be communicated via email or a website notice. Continued use of the website after the effective date of any update constitutes acceptance of the revised Terms.
